Trial Attorney – Constitutional Torts (Bivens)

About the role

The Department of Justice seeks a qualified Trial Attorney to join the Constitutional Torts/Bivens Section. The attorney will support the preparation and conduct of hearings, settlement negotiations, and trials involving constitutional tort claims.

Key responsibilities

• Assist in preparing and conducting hearings, negotiations, and trials.
• Draft memoranda, pleadings, motions, briefs, and other legal documents based on thorough factual and legal research.
• Review case facts, develop evidence, and apply relevant legal principles.
• Consult with senior attorneys to plan trial strategy and examine witnesses.
• Negotiate settlements with opposing counsel under senior guidance.
• Report case status to senior leadership and coordinate with Division officials.
• Respond to inquiries from the White House, Congress, federal agencies, and other stakeholders as needed.
• Perform special legal and administrative projects requiring sound judgment.

Required profile

• U.S. citizen or national.
• J.D. or equivalent degree and active bar membership in good standing.
• Minimum of four (4) years post‑J.D. legal experience.
• Ability to obtain and maintain a Top Secret clearance with SCI eligibility (as required).
• Willingness to complete a background investigation, drug test, and financial disclosure.
• Male applicants born after 12/31/1959 must be registered with the Selective Service.
