Trial Attorney – Enforcement and Affirmative Litigation

About the role

The Branch seeks a Trial Attorney to lead both enforcement actions under key consumer‑protection and public‑safety statutes and affirmative litigation that secures nationwide compliance with federal law. The attorney will partner with client agencies, direct investigations, and manage all phases of district‑court litigation.

Key responsibilities

• Enforce consumer‑protection laws covering health, safety, data privacy, and identity integrity.
• Investigate unlawful conduct and pursue enforcement actions nationwide, including cases involving opioids, unsafe food/drugs, deceptive trade practices, and data‑privacy violations.
• Handle all stages of district‑court litigation: take and defend depositions, manage written discovery, conduct legal research, draft briefs and motions, and conduct trials.
• Represent the United States in affirmative litigation against states, municipalities, and private entities that conflict with federal law.
• Prepare statements of interest, amicus briefs, and other filings when the United States has a vested interest.
• Work on a broad range of issues such as artificial intelligence, energy independence, public benefits, immigration, and public safety.

Required profile

• U.S. citizen or national.
• Admission to a state bar and substantial trial‑court experience.
• Demonstrated ability to manage complex, multi‑jurisdictional litigation.
• Strong legal research, writing, and oral advocacy skills.
• Experience in consumer‑protection, federal preemption, or related public‑policy litigation.
