Trial Attorney (Tax Litigation Branch)

About the role

The Trial Attorney in the Tax Litigation Branch works within the Appellate Section of the Department of Justice, handling complex tax-related appeals in federal and state courts. This position offers the opportunity to engage in high‑level appellate work and support the Office of the Solicitor General.

Key responsibilities

• Prepare and file appellate briefs for United States Courts of Appeals, the United States Tax Court, the Court of Federal Claims, and state appellate courts.
• Present oral arguments before appellate courts nationwide.
• Review adverse decisions and draft recommendations to the Office of the Solicitor General on whether to appeal.
• Assist in preparing briefs for the United States Supreme Court.
• Collaborate with experienced litigators in a collegial environment.

Required profile

• U.S. citizen or national; must pass a background investigation and drug test.
• Male applicants born after 12/31/1959 must be registered with the Selective Service.
• Possess a J.D. or equivalent and be licensed to practice law in any U.S. state, territory, or the District of Columbia, with active bar membership in good standing.
• At least four (4) years of post‑J.D. legal experience to qualify at the GS‑15 level.
• May be required to obtain and maintain a Top Secret security clearance with SCI eligibility.
• Position is onsite; candidates may be placed at any Department duty location nationwide.
