Trial Attorney – Tax Litigation Branch

About the role

The Tax Litigation Branch seeks experienced trial attorneys to serve as front‑line litigators for the United States in tax disputes across federal district courts, bankruptcy courts, the Court of Federal Claims, and occasionally state courts. The position involves a diverse caseload, extensive travel, and the opportunity to shape federal tax law.

Key responsibilities

• Develop and litigate tax cases independently and as part of a team.
• Take and defend depositions, draft and argue motions, and conduct trials.
• Work with fact and expert witnesses to support case strategy.
• Defend the United States in tax refund actions and affirmative suits to collect taxes.
• Challenge constitutional and statutory provisions of the Internal Revenue Code.
• Obtain injunctions against fraudulent tax shelter schemes.
• Represent the United States in bankruptcy, receivership, and probate proceedings.
• Enforce civil penalties, including foreign financial account reporting requirements.
• Defend IRS employees in Bivens actions and enforce IRS administrative summonses.
• Protect U.S. immunity from state and local taxation.

Required profile

• U.S. citizen or national.
• Successful completion of a background investigation, including drug testing.
• Male applicants born after 12/31/1959 must be registered with the Selective Service or qualify for exemption.
• May be required to complete a two‑year trial period.
• Potential requirement to obtain and maintain a Top Secret security clearance with SCI eligibility, depending on assignment.
• Must agree to a drug‑free workplace policy.
• Financial disclosure required in accordance with DOJ and federal ethics guidelines if selected.
